The case involving Kaizer Chiefs and Sundowns regarding defender Fabian McCarthy is still in limbo. The reason is that the South African Football Association (Safa) has not yet arranged arbitration.

Sundowns had argued that McCarthy should not have been allowed to register for Chiefs, after his contract had expired with the Brazilians.

“Until arbitraton has been arranged, we can do nothing. The matter was supposed to be heard today (Thursday April 24) by the Disciplinary Committee, but was removed from the role, depending the outcome of the arbitration,” PSL prosecutor Mxolisi Zwane said.

“No date has yet been set. What will happen is that the names of three advocates will be forwarded to the clubs, and the clubs will have to nominate one. If they cannot agree on the same person, then Safa will decide on the matter.”

Zwane also stressed that it was a matter between the two clubs, and that no other club would be able to benefit. “I have seen newspaper reports that teams would be able to get points if McCarthy was fielded in matches against them. But that is not true, because clubs can only benefit if the protest was made on the field of play, or within 72 hours of the match having being played,” Zwane said.

Zwane said that he hoped the matter would be speedily resolved in the interest of the game.
