The hearing between Sundowns, SA Football Association, Premier Soccer League and Kaizer Chiefs over the validity of Fabian McCarthy's registration was not resolved on Monday as expected after Sundowns had questioned the legality of Arbitrator Hilton Epstein.

According to sources, Sundowns tried to establish whether the arbitrator was properly constituted or not.

SC Epstein, who also resolved the case that involved Hellenic and AmaZulu in the Gareth Ncaca matter, is expected to give the outcome today (Tuesday).

If SC Epstein does continue with the case, he is likely to give his verdict on the McCarthy case on Thursday. However, if he does not continue, a new arbitrator will be appointed and the case could drag on for a couple of days or weeks.

Regarding the appointment of the arbitrator, both Chiefs and Sundowns were given three names, SC Epstein, being one of them. Advocate David Beasley was ruled out as he was going to be a presiding judge in another case.

SC Nazeer Cassiem was also ruled out as Chiefs felt there was going to a conflict of interest after he had acted on behalf of Sundowns in the Labour Court against McCarthy.
