- Introduction
- This promotional competition (“Competition”) is run by The South African Breweries (Pty) Limited in conjunction with Kaizer Chiefs FC and Orlando Pirates FC (“Promoter”) and is open to all members of the public who are 18 years of age or older and residents in South Africa, with the exception of the employees of the Promoter and their immediate families, the Promoter’s advertising and promotion agencies employees and their immediate families, the Promoter’s associated companies, and outlet owners and their immediate families and employees.
- The rules set out in this document constitute the rules which will govern the Competition (“Competition Rules”).
- Participation in the Competition by an entrant (“Participant”) constitutes acceptance of these Competition Rules.
- Promotion Period and number of entries
- The Competition period will be between 28 April 2020 and the ending at midnight on 06 May 2020 (the “Competition Period”).
- Entries will only be accepted up until 23h59 on 01 May 2020.
- There is no restriction on the number of entries by a single Participant.
- Participation Process
- Internet access and a twitter account is required to enter the Competition. In order to participate in the Competition, Participants must enter by posting a video of themselves on twitter performing a football skill at home and tag the video with #ChampionsStayAtHome. All Participants must clearly demonstrate which club they support between Kaizer Chiefs FC and Orlando Pirates FC, by wearing Kaizer Chiefs FC or Orlando Pirates FC supporters’ gear or colours.
- Participants are liable for their own data and voice charges in respect of the Competition participation and the verification process.
- All Participants who are selected via Twitter will be verified as complying with the Participant eligibility criteria set out in the clause 1.1 and be required to verify their address for delivery of prizes, prior to being selected to compete as a finalist.
- The top ten (10) Participants will be selected to be eligible for playing in the final (“Semi- Finalists”) by a panel, consisting of the six (6) selected captains (three (3) from each club), other representatives from both clubs, their affiliates and four (4) from the Carling Brand Team (“Panel”).
- If the Panel cannot reach agreement on the 10 Semi-Finalists by 23:59:00 on Saturday 02 May then the 10 Participants with the most “LIKES” on twitter, 5 from each club will be selected as the Semi-Finalists using the Crimson-Hexagon third party social reporting tool.
- Five (5) of the Semi-Finalists will represent Kaizer Chiefs FC and the other five (5) of the Semi-Finalists will represent Orlando Pirates FC. The Semi-Finalists will each receive a Carling Black Label brand and club hamper for the football club they represent. The hampers will only be couriered by the Promoter to the Semi-Finalist to the verified address after lockdown restrictions on provincial travel and the transport of alcohol restrictions have been lifted.
- Two (2) of the ten (10) Semi- Finalists, will be selected as Finalists. One (1) Finalist will be selected by the Kaizer Chiefs FC panellists to represent Kaizer Chiefs FC in the finals, and one (1) Finalist will be selected by the Orlando Pirates FC panellist to represent Orlando Pirates in the finals (“Finalists”). The Finalists will receive a VIP Champion Fan Experience to be announced later by the Carling Black Label brand.
- If the Panel cannot reach agreement on the two (2) Finalists by 10:00 on Tuesday 5 May then the two (2) Participants with the most “LIKES” on twitter, one (1) from each club will be selected as the Finalists using the Crimson-Hexagon third party social reporting tool.
- In additional to the VIP Champion Fan Experience, the Finalists will be entitled to nominate a Non-profit Organisation of their choice to receive a R10 000.00 (ten thousand rands) donation, paid directly by the Promoter to such Non-profit Organisation. The selected Non-profit Organisation must be registered in accordance with the provisions of Non-profit Organisation Act no. 17 of 1997. If the Winner is unable or refuses to select a Non-profit Organisation within a reasonable time of three weeks after final game, the Promoter will select a suitable Non-Profit organisation on their behalf.
- In the Finals, the Finalist with the most votes on twitter wins the Competition and wins the main prize (“Winner”).
- Main Prize Details
- The Winner will receive the title of being the champion and an opportunity to showcase their skills during halftime at a future game to be announced later by the Carling Black Label brand.
- If the Winner is unable for any reason to attend the scheduled game he/she/they will not be compensated with other prizes nor be permitted to transfer their prize or any elements thereof to another day/match or another person, nor redeem the cash value.
- The Promoter will not be responsible for any claims relating to forfeiture or inability to use the main prize for the Champions Stay at Home football skills challenge.
- Please note that the Promoter may at their own discretion remove and change a Semi-Finalist, Finalist or Winner on the grounds of conduct and/or actions, which are deemed not to align with the Promoter’s Values.
- Reasonable and necessary travel and accommodation costs are included in the main prize for the Winner. All other prizes, i.e. the brand hampers, exclude travel and accommodation of any sort.
- The main prize will only be awarded after successful verification of the Winner. The Winner will be required to provide proof of age by way of a valid South African ID card or ID book. Failing successful verification of any Winner, A substitute Winner may be selected, at the discretion of the Promoter.
- If the Promoter is unable to contact or verify the selected Winner within a four (4) week period, the Winner will be disqualified, and the runner up will be selected as the Winner.
- If the Winner cannot attend or is disqualified the Promoter may nominate the next runner-up with the most votes on Twitter as the Winner.
- General
- All Participants must heed the South African Government’s Lockdown Regulations under the Disaster Management Act 57 of 2002 (“Lockdown Regulations”) and the President’s call to Stay At Home, so any video submissions exhibiting non-compliance with the Lockdown Regulations will not be considered and will automatically be disqualified.
- The Competition Rules may be amended by reasonable notification at any time during the Competition Period, and will be interpreted by the Promoter only.
- Participation by the entrants will automatically constitute acceptance of these rules.
- The Promoter reserves the right to alter, amend, cancel or extend this Competition in part or in its entirety (including, but not limited to, value and/or prize, bookings and/or planned activities). In the event of an amendment, alteration and/or cancellation, the Promoter will not compensate any individual for any reason whatsoever.
- Subject to clause 4.4, the selection of the Semi-Finalists, Finalist and Winner are deemed as final and entirely up to the discretion of the Panel/ Twitter votes and/or the Promoter.
- Participants’ consent to being contacted by the Promoter via SMS/Direct Message to advise them of their progress in this Competition.
- In the event of a dispute, the Promoter’s decision is final and no correspondence will be entered into.
- As a Participant in the Competition, by entering the Competition, you:
- irrevocably and unequivocally agree to grant the Promoter or its agents, in terms of Section 51 of the Electronics Communications Transaction Act 25 of 2002, permission to use your appearance, any photographs, video footage, broadcast and/or telecast footage in which you appear in your Competition entry video/s. This is regardless of the extent of use of the aforesaid by the Promotor, the number of times the video is viewed or broadcast, throughout the world, in perpetuity in any and all manner and media, whether now known or hereafter developed or discovered;
- agree and consent to your Competition entry video/s being edited in the Promotor’s sole and absolute discretion;
- consent to the use of your name, likeness, image, voice, photographs and biographical material about you in connection with the Competition publicity and for related institutional promotional purposes by the Promoter;
- expressly release the Promoter, its agents, employees, licensees and assigns from and against any and all claims which you have or may have for invasion of privacy, defamation or any other cause of action arising out of the Competition and the distribution, broadcast or exhibition of your Competition entry video/s;
- agree that you shall have no claim for payment of any remuneration of any nature whatsoever based on the use and distribution of your Competition entry video/s and waive any and all rights you may have now or in the future thereto; and
- hereby waive any right to inspect and/or approve the finished Competition entry video/s product or products or the editorial, advertising or printed copy or soundtrack that may be used in connection therewith by the Promoter and any right that you may have to control the use to which said product, products, copy and/or soundtrack may be applied.
- The Promoter reserves the right to make media announcements and/or publications of the names and photographs of the Winner, provided that any winner/s may elect to expressly / in writing decline this. Promoter also reserves the right to carry out audits in respect of any entries and Winner of the Competition in order to verify their validity and eligibility.
- All Participants and Winners indemnify the Promoter, their associated and subsidiary companies, directors, officers, employees and agencies, against any and all claims for any loss or damages, whether direct, indirect, consequential or otherwise, arising from any cause whatsoever from their participation in any way howsoever in this Competition.
