Kaizer Chiefs Mobile Win a Toyota Corolla Cross 1.8 XS Competition

Terms and Conditions (Ts & Cs)

• The Kaizer Chiefs Mobile Win a Toyota Corolla Cross 1.8 XS Competition (“the Competition”) is organised jointly by Kaizer Chiefs Telecoms (Pty) Ltd trading as Kaizer Chiefs Mobile and Kaizer Chiefs (Pty) Ltd both of Kaizer Chiefs Village, 5/6 Lena Road, Lenaron, Naturena, Johannesburg (“Kaizer Chiefs Mobile”) and Toyota South Africa Motors (Pty) Ltd of Stand 1 Old Pretoria Main Road, Wesco Park, Sandton, 2146 (hereinafter referred to as “Toyota”) and its respective agencies (collectively termed “the Promoters”).
• The Competition will commence on 1 October 2022 (“the Commencement Date”) and will terminate on 30 June 2023 (“the Termination Date”) (“the Competition Period”). The Competition Period may be extended or curtailed at the sole and absolute discretion of the Promoters.
• All Kaizer Chiefs Mobile subscribers as at the Commencement Date and all new Subscribers who subscribe during the Competition Period (“Subscriber/s”), will be eligible to participate in the Competition and will be considered for the Prizes PROVIDED they meet the entry requirements as specified in point 5.
• Should a Subscriber not wish to continue to participate in the Competition for any reason, they may terminate participation in the Competition upon submission of written notice to that effect, sent to the Promotors on email address marketing@kaizerchiefs.com.
• For a Subscriber to qualify for the Prizes, the Subscriber must:
• be a Kaizer Chiefs Mobile subscriber;
• meet The Regulation of Interception of Communications and Provision of Communication- Related Information Act (“RICA”) requirement in respect of the applicable Kaizer Chiefs Mobile sim card;
• be a natural person over the age of eighteen (18) years of age;
• be a South African citizen permanently resident in South Africa and in possession of a valid South African Identity Document/Card or be in possession of a valid permanent or temporary South African residence permit;
• satisfy the monthly spend over a three (3) consecutive month period prerequisite requirement – see point 10.
• (“Qualifying Participant/s”).
• The Competition will afford Qualifying Participants the opportunity to win the following:
• a new Toyota Corolla Cross 1.8 XS (“Grand Prize”); and
• one of ten (10) Kaizer Chiefs’ merchandise hampers each worth R2,500.00.
• (“the Prizes”)
• The following persons are excluded from participating in the Competition:
• persons below the age of eighteen (18) years;
• legal persons of any nature whatsoever;
• any shareholder, director, employee, independent contractor, consultant, agent, supplier, service provider of either Kaizer Chiefs Mobile or Toyota and their immediate family members, life partners, business partners and associates and any person involved, directly or indirectly, in any aspect of this Competition;
• Kaizer Chiefs Mobile sim cards used in routers will be excluded from the Competition.
• By entering the Competition, all Qualifying Participants and eventual Prize winners agree to be bound by these Ts & Cs which will be interpreted by the Promoters in their sole and absolute discretion. The Promoters’ decision regarding any query or dispute shall be final and binding and no correspondence shall be entered into regarding any decision by the Promoters. The Promoters reserve the right to amend, modify, change, postpone, suspend or cancel this Competition and the award of any Prizes, or any aspect thereof, without notice at any time and for any reason that the Promoters reasonably deem necessary.
• A Qualifying Participant will not be eligible to win the Grand Prize if they have won a vehicle from Toyota or any of its dealers in the last five (5) years, determined from the date of the Grand Prize draw.

Grand Prize - Competition entry mechanics 

• Provided a Subscriber recharges their Kaizer Chiefs Mobile sim card to the amount of R29,00 (Twenty-Nine Rand) or more per month for three (3) consecutive months during the Competition Period and such subscriber also meets the other qualifying requirements specified in points 5.1 to 5.4, the subscriber shall automatically be entered into the Competition for the Grand Prize draw.
• A Qualifying Subscriber’s entry into the Competition for the Grand Prize draw is on the basis of the Kaizer Chiefs Mobile sim card cell number and the subscriber personal information linked in Kaizer Chiefs Mobile’s records to such Kaizer Chiefs Mobile sim card cell number.
• A Qualifying Subscriber will receive one (1) entry into the Grand Prize draw for every three (3) month period during the Competition Period that they meet the requirements as set out in point 10. Each three (3) month period shall not overlap. For the sake of clarity, the Competition Period is over a period of nine (9) months so the maximum number of entries a subscriber may qualify for in the Grand Prize draw is three (3) provided they recharge their Kaizer Chiefs Mobile sim card to the amount of R29,00 (Twenty-Nine Rand) or more per month for each month of the nine (9) consecutive months of the Competition Period.

Monthly Kaizer Chiefs’ merchandise hamper prizes - Competition entry mechanics 

• At the end of each month of the Competition Period, all Subscribers who have recharged their Kaizer Chiefs Mobile sim card to the amount of R29,00 (Twenty-Nine Rand) or more during that month shall qualify to win a Kaizer Chiefs’ merchandise hamper worth R2,500.00 (“Monthly Prize”).

Prizes

• The Grand Prize draw will take place on or before 31 August 2023 and the winner will be announced no later than 31 August 2023.
• The Monthly Prize draw will take place no later than the third (3rd) working day of the month following the month for which the draw is being conducted and each winner will be announced by no later than the tenth (10th) day of each month.
• The Grand Prize and the Monthly Prizes shall be selected randomly from all qualifying participants through an electronic automated selection process which shall be verified by an independent Attorney or Accountant appointed by the Promotor.
• Once a Qualifying Participant wins a Monthly Prize they are immediately disqualified form winning another Monthly Prize but will remain in the draw for the Grand Prize.
• Toyota reserves the right to choose the colour of the Grand Prize.
• The Grand Prize cannot be exchanged for any other vehicle model within the range and the winner does not have the right to change the colour and/or spec of the vehicle.
• The Grand prize does not include insurance on the vehicle nor does it include any extras such as fuel and additional accessories.
• All prizes are awarded at the discretion of the Organiser. The Organiser reserves the right, at its own discretion, to substitute any prize with any other prize of comparable commercial value should the prizes listed above become unavailable.
• Prizes cannot be exchanged for cash.
• The Grand Prize and the Monthly Prizes results will be communicated to all Participants via SMS and via Kaizer Chiefs’ Twitter, Facebook and Instagram social media accounts.
• All drawn Prize winners will be subjected to a verification process prior to any announcement to enable the Promoters to ensure compliance with these Ts & Cs and the relevant provisions of the Consumer Protection Act 68 of 2008. Should any drawn winner refuse or be unable to comply with the Verification Process for any reason, such drawn winner will be deemed to have rejected the prize and it shall revert to the Promoters for a redraw.
• Prize winners will be confirmed only once the Verification Process has been completed to the satisfaction of the Promoters.
• The Verification Process:
• The Promoters will call the drawn winner on the number linked to the Kaizer Chiefs Mobile sim card to which the required minimum recharge relates.
• The Promoters will conduct a personal verification process, including but not limited to the following:
• confirming that the drawn winner holds a valid Identity;
• confirming that the person with whom the Promoters speak to during the Verification Process is the person registered against the relevant Kaizer Chiefs Mobile sim card drawn as a winner;
• requiring the drawn winner to present their original South African identity document or card to the Promoters or their duly appointed agent in person alternatively submit a certified copy of their Identity Document and/or proof of residential address to the Promoters;
• any other verification method deemed necessary and appropriate by the Promotors to achieve the objective of verifying the identity of the drawn winner;
• the drawn winner will be required to complete and sign an acceptance of prize and indemnity agreement (“Acceptance Agreement”), which needs to be returned to the Promoters within forty-eight (48) hours of having received the form.
• (“Verification Process”).
• Prizes shall only be awarded once the Verification Process has been successfully completed, including the verification that the drawn winner satisfies the requirements to be a Qualifying Participant as specified in point 5. In the event of the verification process not being successful, in the sole and absolute discretion of the Promoters, such Subscriber will be immediately disqualified and the draw of a new winner shall take place under the same terms and conditions as the initial draw.
• If the Promoters are unable to contact any drawn winner within forty-eight (48) hours from the time of first attempt by the Promoters to contact them or if a drawn winner fails the Verification Process for whatsoever reason or does not complete or return the Acceptance Form within the time frame permitted, such drawn winner will be disqualified and a new winner will be drawn.
• Neither the Grand Prize nor the Monthly Prizes are transferable or redeemable for cash and the Promoters are not liable for any defect, changes and/or modifications in any of the Prizes.
• The Promoters reserve the right to verify the validity of all entries.

General Terms and Conditions

• By being automatically entered into this Competition, all Subscribers agree to be bound by these Ts & Cs and any additional rules, regulations and requirements as set out in the promotional and marketing materials.
• This Competition is subject to South African law and is not applicable outside South Africa.
• Nothing on the Promoters’ emails or on any Kaizer Chiefs Mobile or Toyota website, or Subscribers’ use of the services or products related hereto, shall be construed as conferring on the Subscriber any right, title or license or other rights under intellectual property or other proprietary rights of any nature whatsoever of Kaizer Chiefs Mobile or Toyota or any of its subsidiaries or affiliates, whether by estoppels, implication or otherwise.
• The Promoters’ decisions shall be final and binding in all matters relating to the Competition and the draws and no correspondence will be entered into.
• The Promoters reserve the right to change these Ts & Cs at any time and without prior notice. A participant shall be deemed to have received notice of any such amendments or interpretations upon publication of the same on the Kaizer Chiefs Mobile website page and shall be deemed to have accepted such amendments or interpretations by virtue of their continued participation in the Competition.
• Should a Subscriber not wish to or to continue to participate in the Competition at any time they may terminate participation in the Competition upon submission of written notice to that effect sent to the Promotors on email address marketing@kaizerchiefs.com.
• The Promoters reserve the right to modify the Competition or disqualify any Subscriber if fraud, misconduct or technical failures destroy the integrity of the Competition as determined by the Promoters, in its sole and absolute discretion.
• The Promoters reserve the right, in its sole and absolute discretion, to cancel, terminate or suspend the Competition and select Prize winners from among all eligible entries received prior to the cancellation.
• The Promoters may, in its absolute and sole discretion, extend any time limit or waive any of the Ts & Cs where a Subscriber might otherwise be disqualified.
• The Promoters may, in its absolute and sole discretion, substitute any Prize with a replacement prize of similar value.
• The Promoters shall not be held liable for any technical failures affecting participation and / or the Prize redemption process of the Competition. In addition, neither the Promoters nor their agents shall be responsible for any loss or misdirected entries, including entries that were not considered due to any failure of hardware, software, or other computer or technical systems affecting participating in and/or the Prize redemption process of the Competition.
• The Promoters, their directors, employees, agents and distributors, shall not be held responsible for any misrepresentation (whether written or verbal) in respect of any Prize nor in respect of any warranties, guarantees or undertakings given by any person other than the Promoters themselves.
• No liability shall attach to the Promoters in relation to any claims, losses or liabilities for any loss of profit or any other direct and/or indirect, special or consequential loss arising out of any of the Prizes. The Promoter is not liable for any defects in the Prizes. Ownership of and risk in, and benefit attaching to the Prizes will pass to the winner immediately upon delivery.
• If the Promoters are required by law to alter or cancel any aspect of the Competition or to terminate it as a result of the application of current legislation or changes in legislation, or for any other reason whatsoever, they will have the right to terminate the Competition with immediate effect and without notice. In such event, all Subscribers hereby waive any rights which they may have against the Promoters and their associated companies, directors, employees, agents, contractors and/or sponsors.
• All Qualifying Participants and the Prize winners, as the case may be, indemnify the Promoters, their advertising agencies, advisers, nominated agents, suppliers and joint ventures identified by the trademarks owned by or licensed to Kaizer Chiefs Mobile and Toyota, their affiliates and/or associated companies against any and all claims of any nature whatsoever arising out of and/or from their participation in any way howsoever in this Competition including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of the Promoters and/or use of the Prizes.
• By participating in the Competition, Subscribers grant Kaizer Chiefs Mobile and Toyota and their marketing agencies to make contact with them for the purposes of this Competition and for, future promotional and marketing activities.
• The Promoters reserve the right, in perpetuity, to use across all and any forms of media and for any reasonable purposes whatsoever arising or attached to the Competition, any Qualifying Participants’ name, photographs, videos, statements or stories pursuant to their participation in the Competition, without their express written permission.
• By participating in the Competition, a Qualifying Participant who does not wish to have their image and/or personal details distributed as provided for or envisaged in point 47 should make their wishes known to the Promoters upon submission of written notice to that effect sent to the Promotors on email address marketing@kaizerchiefs.com.
• By participating in the Competition, Subscribers agree that Kaizer Chiefs and Toyota and their respective affiliates (including the Promoters’ agencies, subsidiaries, and joint ventures) may contact the Subscriber via email and through social media platforms to deliver marketing communications regarding their respective products and promotional activities, provided that the Subscriber is given the opportunity to opt-out of receiving such communications at any time via the appropriate opt-out mechanisms provided by the Promoters for such purpose.
• The winner of the Grand Prize shall be required to accept the Grand Prize in person in Johannesburg at the date and time to be determined by the Promoters. The Grand Prize winner shall be required to participate in all reasonable media, marketing, promotional and like activities arising out of the winning of the Grand Prize as may be determined by the Promoters and shall furthermore be required to sign an intellectual property and image rights release form in favour of the Promoters in relation thereto which shall be valid in perpetuity.
• The Competition is also subject to, and must be read in conjunction with, Kaizer Chiefs Mobile’s existing terms and conditions of use applicable to its website and mobile site.
